BERG TOYS B.V. PRIVACY AND COOKIE STATEMENT

This Privacy Statement explains how we handle your personal data and how you can exercise your rights in this regard.

By "we" or "us", we mean:

BERG Toys B.V., head office Stevinlaan 2, 6716 WB Ede.

We are considered a "controller" within the meaning of the privacy regulations. This means we are responsible for compliance with privacy regulations with regard to your personal data.

Collecting and using personal data of clients or potential clients, including children

We wish to inform you that we will collect and use the personal data you provide us with, primarily because this is necessary to conclude and execute any agreement with you.

If you are a client or potential client of ours, we use your data to send you a quote, determine which specifications or requirements a particular item must meet, deliver items or perform work for you, issue invoices, and communicate smoothly and efficiently with you about the execution of the agreement. For your order we need your name, address, email address, payment details and phone number. This enables us to process and deliver your order. The legal basis for these processing operations is that they are necessary to be able to execute the agreement with you.

We may also use certain personal data to provide a service that will allow you to use certain applications that we offer. One of these applications is the BERG Air Hive-app. To use this app, we need your name, email address, date of birth and country of origin. In addition, this app will be linked to our own social media platform, and posts/photos and videos that you create will be processed by us and possibly placed on our own social media platform. If you are under 16 years old, we need permission from one of your parents or guardians to be able to process this data. In that case, the personal data of your parent/guardian will also be processed. The legal basis for processing this data is that such processing is necessary in order to provide a certain service or execute an agreement with you; or that we have obtained permission from your parents to process this data.

Children who do not have the consent of their parent/guardian are not permitted to provide us with personal data.

Finally, we store your personal data because we are legally obliged to do so under tax legislation.

You are not obliged to provide us with your personal data. If you provide us with no personal data, however, or with insufficient data, we may not be able to perform the abovementioned activities.

Direct marketing

If you have given us permission, we will store the personal data you have provided and use it in the future to inform you personally by newsletter about our new and existing products and potentially offer you a special deal. Every time we send you a newsletter, you can let us know if you no longer wish to receive it. See the unsubscribe link at the bottom of each newsletter.

Transfer to third parties

If necessary for the processing of your order, we will transfer your data to third parties, such as couriers and IT suppliers. We make agreements with our partners to ensure they handle your data with the same care as BERG Toys.

We also use external server rooms to store some of our sales records, which includes your personal data. For that reason, your personal data may be supplied to providers of server rooms. Finally, we may need to provide personal data if required by law or to comply with an order from a competent authority.

Our employees and any third parties engaged by us are obliged to respect the confidentiality of your data. Personal data is therefore safe at BERG Toys.

Where do we keep your personal data, and for how long?

If you have requested a quote from us but are not one of our clients, we will delete your data no later than one year after our last contact. If you are one of our clients, we will keep your personal data for a period of seven years after the end of the financial year in which the agreement was fully executed. The seven-year period corresponds to the length of time for which we are obliged to keep our records for the tax authorities. After this period we will delete your personal data.

The data available to us, including personal data, is stored locally within the European Union, with the exception of data that is processed by third parties for analysis purposes, including Google Analytics.

Your rights

You have the right to request to view your own personal data. If there is reason to do so, you can also ask us to supplement your personal data or correct inaccuracies. You also have the right to request that your personal data be deleted or the use of your personal data restricted.

When using our Berg AirHive app you have the option of deleting your account, in which case all your personal data will be deleted. Following deletion of your account, BERG Toys B.V. will store your content and personal data for another 30 days, after which it will be deleted with no possibility of recovery. You can also object to the collection and use of your data. In addition, there is the option of filing a complaint with a supervisory authority. You can choose to submit the complaint to the Dutch supervisory authority, which is the Dutch Data Protection Authority (the leading supervisory authority), or to the supervisory authority of the Member State where you reside or have your office. More information about this can be found on the websites of the supervisory authorities.

Finally, you can send us a request to obtain your personal data or transfer that data to another person. Cookies

Cookies are small files that are placed on your computer, tablet or smartphone during your visit to our websites. Information is stored and this information will be recognised on a subsequent visit to the websites.

The websites use tracking cookies if you have given permission for this. We do this to gain insight into your internet behaviour so we can make you suitable offers. You can withdraw your consent at any time. Your data is stored for a maximum of one year. We also place functional cookies. We do this to facilitate the use of the websites. This means the purchased products remain in the shopping cart, for example, or that your login details are remembered during your visit.

Analytical cookies show us which pages have been visited and what parts of the websites receive clicks. Finally, we would like to point out that when you visit the websites, you leave no personal data unless you enter your personal information in our contact form.
